These Terms of Service (the "Terms") are a legally binding agreement between you and RizvaHub Team ("we", "us", or "our") governing your access to and use of the RizvaHub mobile application and related services (the "Service").
1) Acceptance of These Terms
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
3) Privacy
Your use of the Service is also subject to our privacy practices, which explain how we collect and use information. Please review them wherever they are made available within the Service or on our official publishing channels.
4) The Service
RizvaHub transforms your travel experiences into a curated landscape diary. You can capture scenery, attach location tags and personal notes, explore a dynamic landscape map, and revisit adventures through a travel timeline and monthly retrospectives. The Service may evolve over time, and we may add, modify, or remove features at any time.
5) Accounts
5.1 Account registration
You may need to create an account to use certain features. When you create an account, you agree to provide accurate information (such as name/username/email) and keep it updated.
5.2 Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
5.3 Suspension and termination
We may suspend or terminate your account if we reasonably believe you violated these Terms, used the Service unlawfully, or posed a security risk. You may stop using the Service at any time.
6) Your Content
6.1 Definition
"User Content" includes photos, notes, titles, descriptions, location tags, and other materials you submit, upload, or otherwise make available through the Service.
6.2 Ownership
You retain ownership of your User Content.
6.3 License to operate the Service
You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display your User Content solely as necessary to operate, maintain, and provide the Service (including creating entries, showing your timeline/map, syncing where enabled, and providing support). This license ends when your User Content is deleted from the Service, except to the extent we must retain it for legal, security, or backup purposes consistent with our privacy practices.
6.4 Your responsibilities
You are responsible for your User Content and represent that you have all rights necessary to submit it and that it does not violate any law or infringe any third-party rights.
7) Acceptable Use
You agree not to:
- Use the Service in any way that violates applicable law or regulation
- Upload or share content that is illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable
- Infringe the intellectual property, privacy, or other rights of others
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service, including by introducing malware or abusing APIs
- Reverse engineer, decompile, or attempt to extract source code except where prohibited by law
8) Optional Automated / AI-Assisted Features (If Offered)
The Service may offer optional automated analysis or enhancement features for your photos or text (sometimes referred to as "AI-assisted" features). If you choose to use such features:
- You control whether to upload any inputs and whether to save outputs.
- Inputs may be processed on our servers to provide the requested results.
- We will handle inputs and outputs as described in our privacy practices, including not sharing them with third parties for these features and deleting inputs promptly after processing where applicable.
9) Intellectual Property
The Service and its content, features, and functionality (excluding your User Content) are owned by RizvaHub Team and are protected by intellectual property laws. You are granted a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.
10) Third-Party Services
The Service may interact with third-party services (for example, operating system services such as maps/location, photo libraries, or analytics). We are not responsible for third-party services and your use of those services is governed by their own terms and policies.
11) Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation to you.
12) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIZVAHUB TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14) Indemnification
You agree to indemnify and hold harmless RizvaHub Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.
15) Changes to the Service and Terms
We may update the Service and these Terms from time to time. If we make material changes to these Terms, we will provide notice through the Service or other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance.
16) Governing Law
These Terms are governed by the laws of our principal place of business, without regard to conflict of laws principles, except where your local law requires otherwise.
17) Dispute Resolution; Binding Arbitration
Except where prohibited by law, you and RizvaHub Team agree that disputes arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not in court.
- No class actions: Arbitration will proceed only on an individual basis.
- Administrator / rules: The arbitration will be administered by a reputable arbitration institution mutually agreed by the parties, under its applicable rules, in English, unless the parties agree otherwise.
- Location: The arbitration may be conducted remotely (e.g., by video conference) unless the arbitrator determines an in-person hearing is necessary.
- Injunctive relief: Either party may seek interim or injunctive relief in a court of competent jurisdiction to protect its rights pending completion of arbitration, where permitted by law.
If binding arbitration is not enforceable in your jurisdiction, disputes will be resolved in the courts located in our principal place of business, unless otherwise required by law.
